TERMS AND CONDITIONS OF USE

These Terms and Conditions (“Terms”) govern the access and use of the website bolabuddy.com and the mobile application of BolaBuddy (hereinafter, collectively referred to as the “Platform” or the “Services”).

By accessing, downloading, or using our Platform, you (the “User”) agree to be legally bound by these Terms. If you do not agree with any of the terms set forth in this document, you must not use our Services.

1. Use of the Platform

  • Eligibility: To use the Platform, the User must be at least the age of legal majority in their jurisdiction of residence or have the express consent of their parents or legal guardians.

  • Account Creation: You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify BolaBuddy immediately of any unauthorized use.

  • Accuracy of Information: The User agrees to provide true, accurate, and up-to-date information when registering and using the Platform.

2. User Conduct and Acceptable Use

The User agrees to use the Platform in accordance with the law, morals, public order, and these Terms. It is strictly prohibited to:

  • Use the Platform for any illegal, fraudulent, or unauthorized purpose.

  • Interfere with, disrupt, or compromise the security of the Platform, its servers, or connected networks.

  • Copy, modify, distribute, sell, or reverse-engineer any part of the Platform or our software.

  • Transmit viruses, malware, spam, or any other code of a destructive nature.

  • Harass, intimidate, or violate the privacy rights of other users.

BolaBuddy reserves the right to suspend or terminate your account without prior notice if we determine, at our sole discretion, that you have violated these rules.

3. Intellectual Property

All content, design, source code, logos, trademarks, texts, graphics, user interfaces, and software present on the Platform are the exclusive property of BolaBuddy or its licensors and are protected by applicable intellectual and industrial property laws.

No right or license, express or implied, is granted to the User over the company’s intellectual property, except for the limited, non-exclusive, and non-transferable right to use the Platform for its intended personal or commercial purpose (as offered by the company).

4. User-Generated Content

If the Platform allows the posting or uploading of content by users (comments, images, reviews):

  • You retain ownership rights to your content, but you grant BolaBuddy a worldwide, perpetual, irrevocable, royalty-free, and transferable license to use, reproduce, modify, adapt, publish, and display such content in connection with the operation and promotion of the Services.

  • You are solely responsible for ensuring that your content does not infringe on third-party rights or violate any laws.

5. Privacy and Data Protection

The collection and use of users’ personal information are governed by our Privacy Policy. By using the Platform, you agree to the data processing practices described in that document.

6. Third-Party Links

The Platform may contain links to third-party websites, applications, or services that are not owned or controlled by BolaBuddy. We assume no responsibility for the content, privacy policies, or practices of any third-party sites. Access to these links is at your own risk.

7. Limitation of Liability and Disclaimer of Warranties

  • “As Is” Service: The Platform and all services are provided on an “as is” and “as available” basis. BolaBuddy makes no warranties of any kind, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • Availability: We do not guarantee that the Platform will be uninterrupted, error-free, secure, or that any defects will be corrected immediately.

  • Damage Limits: To the fullest extent permitted by applicable law, BolaBuddy, its directors, employees, partners, or agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, resulting from the access or use, or the inability to access or use the Platform.

8. Indemnification

The User agrees to defend, indemnify, and hold harmless BolaBuddy from and against any claims, lawsuits, damages, obligations, losses, liabilities, costs, or debt (including attorney’s fees) arising from:

  1. Your use of and access to the Platform.

  2. Your violation of any provision of these Terms.

  3. Your violation of any third-party right, including any intellectual property or privacy right.

9. Modifications to the Terms

BolaBuddy reserves the right to modify, update, or replace these Terms at any time and at its sole discretion. If the changes are material, we will attempt to notify users with reasonable notice (for example, through the application or via email). Your continued use of the Platform after the posting of any modifications will constitute your acceptance of the new Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of NJ, United States, without giving effect to any conflict of law provisions. Any dispute arising in connection with these Terms or the use of the Platform shall be submitted to the exclusive jurisdiction of the competent courts located in New Jersey, United States.
